Terms of Service

Last Updated: October 24, 2023

1. Acceptance of Terms

By accessing or using GitInTheVan ("the Service"), operated by Tydorius ("the Operator"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

GitInTheVan is an open-source Large Language Model (LLM) router designed for writers and roleplayers. The Service provides a public-facing web interface hosted at gitv.ai. The underlying source code is open-source, and users are encouraged to run their own local instances. The public instance is provided as a convenience and is funded by community donations.

3. Acceptable Use & Content Restrictions

You are solely responsible for all content generated, processed, or stored using the Service. To ensure compliance with our hosting providers (including, but not limited to, SSDNodes) and upstream API providers, you agree NOT to use the Service to generate, store, or transmit any of the following:

  • Adult or Explicit Content: No pornographic, sexually explicit, or NSFW (Not Safe For Work) content is permitted on the public hosted instance.
  • Illegal Content: Content that violates any local, state, national, or international law, including but not limited to content that promotes terrorism, violence, or illegal acts.
  • Harmful or Malicious Content: Malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to systems.
  • Spam or Abuse: Using the Service to send unsolicited messages, or engaging in network abuse, port scanning, or denial-of-service attacks.
  • Infringing Content: Content that infringes upon the copyrights, trademarks, or intellectual property rights of others.

The Operator reserves the right to terminate access immediately and without warning for any violation of this section. If you wish to generate NSFW content, you must run GitInTheVan locally on your own hardware.

4. Upstream Provider Compliance

The Service may route requests to third-party LLM providers (e.g., OpenAI, Anthropic). You agree to comply with the Acceptable Use Policies and Terms of Service of any such upstream providers.

5. Disclaimer of Liability & "As-Is" Use

The Service is provided on an "as is" and "as available" basis. The Operator makes no warranties, express or implied, regarding the reliability, availability, or accuracy of the generated text. The Operator is not liable for any loss of data, unexpected downtime, or inaccurate AI outputs. Users are highly encouraged to maintain local backups of their lorebooks, scripts, and writing.

6. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

7. Donations and Costs

The public instance of GitInTheVan is funded entirely by donations via Ko-fi. The Operator does not guarantee continuous uptime and may limit usage, throttle requests, or shut down the public instance at any time to manage server costs.

8. Changes to Terms

The Operator reserves the right to modify these Terms at any time. Users will be notified of significant changes via the application or GitHub repository. Continued use of the Service after changes constitutes acceptance of the new Terms.
